1. Agreement to these terms
These Terms of Service ("Terms") are a binding agreement between you (personally or for the organisation you represent) and PPELLM, Switzerland ("PPE LLM", "we", "us"). They cover the website www.ppellm.com, the PPE LLM iOS and Android apps, our emails and any other channel that links to these Terms (together, the "Site"). By using the Site you confirm you have read and accepted these Terms. If you do not accept them, do not use the Site.
We may change these Terms. The "Last updated" date at the top tells you when. Changes take effect when they are posted; we may, but do not have to, tell you about them. Using the Site after a change means you accept the new version. Other policies we post — the Privacy Policy, the Cookie Policy and the Disclaimer — are part of these Terms.
The Site is for people aged 18 or older. It is not aimed at any country where its use would be illegal or would require us to register; if you use it from such a place, that is your decision and your responsibility. The Site is not built to meet sector-specific rules such as HIPAA or GLBA — do not use it in a way that would be covered by them.
2. What the Site does, and what it is not
PPE LLM sends your question to several large language models run by third-party providers, lets them compare and challenge each other's answers, and shows you the outcome. All output is automatically generated text. It is general information, not a personal recommendation, and not medical, health, legal, financial, investment, tax, accounting, engineering, safety or other professional advice. Language models can misread a question, invent facts, cite sources that do not exist and state wrong things with confidence; no person reviews an answer before you see it.
Decisions you make with the Site are yours alone. Before acting on an answer, verify it at the source and consider talking to a licensed professional. See also the Disclaimer.
3. Accuracy and availability of answers
We do not promise that any answer is accurate, complete, current or consistent, that a particular model will be used, or that the same question will get the same answer twice. The models, providers and the way answers are combined can change at any time. An answer may be refused, cut short or delayed because of provider limits, safety filters or outages that we do not control.
4. Your account
To use the Site you need an account (email, username, password). You promise that the information you give us is true and that you will keep it up to date; that you have the legal capacity to enter this agreement; that you are not a minor where you live; and that you will not use the Site through bots or scripts, for anything illegal, or in breach of any law. Keep your password secret — everything done under your account counts as done by you. Tell us at once if you think someone else has used it. We may change or reclaim a username that is misleading or offensive.
You can delete your account at any time from the account page. Any subscription is cancelled at the same time (section 6), and any remaining prepaid balance is forfeited. For 30 days you can recover the account by logging in again; after that the deletion is permanent and your conversations are gone.
5. Plans and allowances
The Site has a free plan and paid plans. Each plan comes with an allowance — a dollar amount of AI usage that your questions consume, depending on their length and the models used. The free plan's allowance is granted once and does not renew. Paid plans renew their allowance every month; to keep the service fair, a share of the monthly allowance is also capped per day and per week. The current plans, prices and allowances are shown on the subscription page and may change over time; a change never affects a period you have already paid for. When an allowance is used up, the service pauses until the period resets, until you upgrade, or until you use prepaid balance (section 7).
6. Subscriptions, renewal and cancellation
Paid plans are subscriptions billed monthly in advance. A subscription renews automatically at the end of each month until you cancel it, and you authorise our payment provider, Stripe, to charge your payment method for each renewal until then.
You can cancel at any time with the "Manage Subscription" button on your account page, which opens Stripe's billing portal. Cancellation takes effect at the end of the period you have already paid for; you keep the paid features until then. We do not refund or credit partial periods. If a renewal payment fails, Stripe retries for a limited time; if every attempt fails, the subscription is cancelled automatically and paid features stop. Prices are shown before you pay and include any applicable taxes unless stated otherwise. We may change the price of any plan or feature at any time, as often as we want and by any amount, without notice; a new price applies from your next renewal, and you can always cancel before it.
All payments are final. We do not refund or credit any payment, in whole or in part, for any reason, except where the law requires it. If you are a consumer in the EU/EEA or the UK, the law gives you a 14-day right of withdrawal from a subscription purchase; because paid features are available immediately, by buying you expressly ask us to start the service at once and acknowledge that you lose this right of withdrawal as a result, to the extent the law allows.
7. Account balance top-ups
You may buy one-time top-ups that add a prepaid balance to your account. The balance pays for AI usage beyond the allowance of your plan, at the same rates. Balance is non-refundable and never expires, but it is forfeited if your account is deleted. There is a maximum balance per account, shown on the subscription page; a top-up that would exceed it cannot be bought. Balance has no cash value and cannot be transferred to another account. Credit we grant ourselves (for example as a thank-you for a survey) is subject to the same rules.
8. Ending your use of the Site
These Terms apply for as long as you use the Site. We may suspend or close any account, block any IP address or refuse service to anyone, at any time, for any reason or no reason, without warning and without refund. If we close your account you may not open a new one. We may also change, limit, stop or remove the Site or any feature, in whole or in part, at any time, without warning and without refund, including features included in a plan you have paid for.
9. What you may not do
You may use the Site only for its intended purpose: asking questions and reading the answers for your own use. You agree not to:
- use the Site to generate content that is illegal, that infringes someone's rights, that is meant to harm, harass, deceive or defraud anyone, or that violates the acceptable-use rules of the AI providers we rely on;
- access the Site with bots, scripts, offline readers or any automated tool, create accounts automatically or under false pretences, or resell access to the Site;
- mass-download or systematically copy answers to build a dataset, product or service, or use the Site to train or improve another AI model;
- bypass, disable or test security features, allowance limits, plan gating or other technical restrictions;
- copy, adapt, decompile or reverse-engineer the Site's software except where the law expressly allows it;
- share your account, sell or transfer it, or impersonate another person;
- upload malware or anything that disrupts or overloads the Site or its networks;
- collect other users' usernames or email addresses, send spam, or harass anyone connected with the Site;
- frame or link to the Site in a way that misrepresents it, remove copyright notices, or use the Site for anything illegal.
10. Intellectual property
The Site — its code, design, text, logos and marks, and the way answers are produced and combined — belongs to us or our licensors and is protected by copyright and trademark laws. We grant you a limited, personal, non-transferable licence to use the Site as long as you follow these Terms. All other rights stay with us.
11. Your questions, the answers and feedback
You keep ownership of the questions and attachments you enter. You give us the right to store and process them to run the Site for you, including sending them to the AI providers, as described in the Privacy Policy. You confirm you are entitled to submit them. The Site has no public posting; nothing you enter is shown to other users.
To the extent we hold any rights in an answer generated for you, we assign them to you; you may use answers for any lawful purpose. Because answers are generated automatically, the same or a similar answer may be given to other users, and we cannot promise that an answer is original or free of third-party rights. You are responsible for how you use it.
If you send us suggestions or feedback, you agree that we may use them to improve the Site without owing you anything and without confidentiality obligations.
12. Mobile applications
If you use the PPE LLM app for iOS or Android, we grant you a revocable, non-exclusive, non-transferable licence to install and use it on devices you own or control, following these Terms and the rules of the app store you got it from. You may not decompile or modify the app, remove its notices, use it for commercial purposes, make it available to several users or devices at once, use it to send automated queries or unsolicited email, or use it to build a competing product.
Apple and Google (each an "App Distributor") are not parties to these Terms and have no obligation to support or maintain the app. We are responsible for the app and its support as set out here. If the app does not meet an applicable warranty, you may tell the App Distributor, which may refund any purchase price paid for the app (there is none — the app is free) and has no other warranty duty. You confirm that you are not in a country under a US government embargo or on a US list of prohibited parties, and that you will respect any third-party terms (for example your mobile carrier's) when using the app. The App Distributors are third-party beneficiaries of this section and may enforce it against you.
13. Third-party websites and content
Answers may link to or quote external websites, and the Site links to Stripe's billing pages and the app stores. We do not check or control them and are not responsible for their content, accuracy, availability or privacy practices. A link is not an endorsement. Anything you buy on another site is a contract between you and that site alone.
14. Availability, changes and site management
We may change, add or remove features, models, content and prices at any time, and we may monitor the Site for breaches of these Terms and take action to protect it. We try to keep the Site available but cannot guarantee it: maintenance, hosting or AI-provider problems, or events outside our control can cause interruptions or errors. We are not liable for downtime, and no refund or credit is owed for it.
15. Privacy
How we handle personal data is described in the Privacy Policy, which is part of these Terms. The Site is hosted in Germany and some providers process data in other countries, as explained there.
16. Corrections
The Site may contain typing errors, inaccuracies or omissions, including in descriptions, prices and availability. We may correct them and update the Site at any time without notice.
17. No warranty
The Site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and any warranty that any answer or content is accurate, complete, current or error-free, that the Site will be uninterrupted or secure, or that any result obtained through it is reliable. You use the Site at your own risk.
18. Limitation of liability
To the fullest extent the law allows, PPE LLM and the people working for it are not liable to you or anyone else for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or any loss arising from reliance on an answer, arising from your use of or inability to use the Site, even if we were told such damages were possible. In every case, our total liability for all claims together is limited to the amount you paid us in the three months before the event that gave rise to the claim.
Nothing in these Terms excludes or limits liability for intent or gross negligence, for death or personal injury caused by our negligence, or any other liability that cannot be limited under the law that applies to you. If you are a consumer, the mandatory rules of your country of residence take precedence over sections 17 and 18 where they conflict.
19. Indemnity
If a third party brings a claim against us because of your breach of these Terms, your unlawful use of the Site, or content you submitted that infringes someone's rights, you agree to compensate us for the resulting loss, including reasonable legal costs. We will tell you about such a claim and may take over its defence; you agree to cooperate reasonably.
20. Your data and backups
We keep your conversations and data about your use of the Site to run it, and we make regular backups. You are still responsible for keeping your own copies of answers you care about. Except where section 18 says otherwise, we are not liable for loss or corruption of data.
21. Electronic communications
Using the Site, emailing us or filling in our forms are electronic communications. You agree to receive communications from us electronically (by email and on the Site) and that they satisfy any requirement that a communication be in writing. You also agree to electronic contracts, orders, receipts and signatures, and to electronic delivery of notices and records.
22. Governing law and disputes
These Terms are governed by the laws of Switzerland, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in the EU/EEA or the UK, you also keep the protection of the mandatory rules of your home country, and you may bring a claim either in Switzerland or in your home country.
Both of us submit to the non-exclusive jurisdiction of the Swiss courts. The European Commission runs an online dispute-resolution platform at ec.europa.eu/consumers/odr. Before going to court, please write to us at contact@ppellm.com — most issues can be sorted out directly.
23. Users in California
If a complaint is not resolved to your satisfaction, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210 or (916) 445-1254.
24. General
These Terms and the policies linked from them are the whole agreement between you and us about the Site. If we do not enforce a right, we have not waived it. We may transfer our rights and obligations under these Terms to a successor of the business; we will tell you if we do. We are not responsible for delays or failures caused by events outside our reasonable control. If a court finds part of these Terms invalid, the rest still applies. These Terms do not create any partnership, employment or agency relationship. They are not to be read against us just because we wrote them, and you accept them even though neither of us signs them on paper.
